Terms of Service

These Terms govern your use of EmoFriend's mobile apps, websites, and related services. By creating an account or using the service, you agree to these Terms and the Privacy Policy.

1. Eligibility

• You must be at least 13 years old, or the minimum digital-consent age in your jurisdiction.
• If you are under 18, you may use the service only when permitted by applicable law and with any required guardian consent.
• You must provide accurate account information and keep your login credentials secure.

2. Nature of the Service

EmoFriend provides emotional wellness, reflection, journaling, and AI-assisted companion tools. It is not a medical device and does not provide therapy, psychiatric care, crisis response, legal advice, or emergency services.

If you believe you may harm yourself or others, contact local emergency services or a crisis line immediately. In the United States and Canada, call or text 988.

3. Accounts and Acceptable Use

• You are responsible for activity under your account.
• You may not use the service to break the law, harass others, abuse the platform, or interfere with its operation.
• You may not attempt to reverse engineer, scrape, exploit, or bypass security or subscription controls.

4. AI Features

Certain features use Azure OpenAI to generate replies, Talk mode responses, summaries, patterns, forecasts, and relationship analysis. These features require explicit in-app consent before personal context is sent for AI processing.

AI output may be incomplete, inaccurate, or unsuitable for your circumstances. You remain responsible for how you interpret and use the output.

5. User Content

You retain ownership of the content you submit, including messages, check-ins, notes, and journal entries. You grant EmoFriend a limited license to host, process, display, and store that content solely to operate and improve the service, comply with law, and enforce these Terms.

6. Subscriptions and Billing

Apple in-app subscriptions

• Premium subscriptions renew automatically unless canceled at least 24 hours before the current period ends.
• Billing is handled by Apple through your Apple ID account.
• You can manage or cancel subscriptions in your Apple subscription settings.
• Refunds for Apple in-app purchases are governed by Apple's policies.

7. Suspension and Termination

We may suspend or terminate access if you violate these Terms, create legal or security risk, or misuse the service. You may stop using the service at any time and may request account deletion.

8. Disclaimers

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, EmoFriend disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

9. Limitation of Liability

To the maximum extent permitted by law, EmoFriend and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability for claims arising from the service will not exceed the greater of the amount you paid to EmoFriend in the prior 12 months or $50 USD.

10. Governing Law

These Terms are governed by the laws of India, excluding conflict-of-law rules. Courts located in Noida, Uttar Pradesh, India will have exclusive jurisdiction unless applicable consumer law requires otherwise.

11. Changes and Contact

We may update these Terms from time to time. Continued use of the service after the effective date of updated Terms means you accept the revised Terms.
